§ 1 Scope and contracting parties
(1) These terms apply to all bookings made via chalet-sonneck.de.
(2) The contracting party is Laurent Mander, Auf der Ritschlay 8,
54669 Bollendorf, hereinafter the “operator”.
(3) You are a consumer within the meaning of Section 13 BGB or an
entrepreneur within the meaning of Section 14 BGB.
(4) The subject of the contract is the short-term letting of a
holiday apartment for temporary use (accommodation contract). The
statutory provisions governing residential tenancies do not apply
pursuant to Section 549 (2) No. 1 BGB.
§ 2 Conclusion of contract
(1) The online request is NOT a binding offer, but an invitation to
submit an offer.
(2) By clicking “Book with obligation to pay”, the guest submits a binding offer to
book.
(3) The contract is concluded only upon an explicit confirmation
e-mail from the operator (usually within 24 hours).
(4) Until confirmation, the requested date is reserved for a maximum
of 24 hours; thereafter the request lapses automatically.
(5) In addition, the guest may submit a non-binding
inquiry (including for periods not yet released for
booking). The operator may then send an individual, time-limited
offer stating the price; in that case the contract is only concluded
upon the guest's acceptance of the offer (click on the acceptance
link). Until acceptance, the dates are not reserved.
§ 3 Services
(1) Provision of the holiday apartment “Chalet SonnEck 69” for
temporary use during the booked period.
(2) Furnishings as described on the detail page at the time of
booking.
(3) The final cleaning (a flat €45.00 per booking) is a mandatory
component and is included in the total price.
§ 4 Prices, visitor’s tax, payment
(1) Prices are final prices including any applicable VAT.
(2) The visitor’s tax is collected pursuant to the bylaw of the
municipality of Bollendorf (standard €1.00 per person per night
from the age of 18). It is part of the total price shown.
(3) Payment methods: (a) bank transfer to the account stated in the
confirmation e-mail OR (b) cash payment in full before the keys are
handed over. Online payment (credit card, PayPal, Stripe) is not
offered.
(4) When paying by bank transfer, the guest may choose between two
payment options in the booking form: (a) payment of the full
amount, due no later than 14 days before arrival, or (b) a deposit
of 30 % of the total price, due within 7 days of receipt of the
booking confirmation; the balance is paid in cash on site when the
keys are handed over.
(5) For short-notice bookings where a deposit pursuant to paragraph
4 is no longer feasible in time, the full amount is due immediately
upon receipt of the booking confirmation; in this case the deposit
option is not offered in the booking form. The chosen payment
option and the specific due dates are stated in the booking
confirmation.
(6) Cash payments are always for the full amount on site; a deposit
is not provided for when paying cash.
(7) The base overnight price covers up to two adults. For each
additional adult and for children aged 6 to 18 inclusive, a
surcharge per person per night applies; the applicable surcharges
are shown transparently in the booking form before the request is
sent and are included in the total price displayed. Infants up to
and including the age of 5 stay free of charge.
§ 5 Minimum stay
(1) The minimum stay is generally 2 nights. During the high season or special periods, the operator may set a different minimum number of nights; these are shown in the calendar before the booking request.
§ 6 Arrival and departure
(1) Arrival: from 3:00 p.m.
(2) Departure: by 11:00 a.m.
(3) Different times only by prior arrangement.
§ 7 Occupancy / house rules
(1) Maximum occupancy: 4 persons (adults and children, strictly
limited). Infants up to and including the age of 5 do not count
towards the maximum occupancy (at most 2 infants).
(2) Pets are not permitted.
(3) Smoking is prohibited inside the apartment.
(4) The house rules (posted on site, linked online) form part of
the contract.
§ 8 Cancellation by the guest (generous model)
(1) Cancellation must be made in writing (e-mail is sufficient) to
mail@chalet-sonneck.de
or online via the personal cancellation link contained in your
booking confirmation e-mail.
(2) The date on which the cancellation is received by the operator
is decisive, calculated against the agreed arrival date:
- 14 days or more before arrival: 0 % cancellation fee
- 13 to 7 days before arrival: 50 % cancellation fee
- 6 days before arrival or later (incl. no-show): 90 % cancellation fee
(3) Any successful re-rental of the period by the operator will be
offset pursuant to Section 537 (2) BGB.
(4) We strongly recommend taking out travel cancellation insurance.
§ 9 Withdrawal by the operator
(1) Permitted in particular in the event of force majeure, official
orders, payment default of more than 7 days after the due date, or
obviously misleading information provided by the guest when
booking.
(2) In these cases, amounts already paid will be refunded promptly
and in full; further claims for damages by the guest are excluded
unless the operator acted intentionally or with gross negligence.
§ 10 Liability
(1) The operator’s liability for slight negligence exists only in
the event of a breach of essential contractual obligations
(“cardinal obligations”) and is limited to the foreseeable damage
typical for the contract.
(2) Liability for intent, gross negligence, injury to life, body or
health, and under the Product Liability Act (ProdHaftG) remains
unaffected.
(3) The guest is liable for damage to the apartment and its
contents caused intentionally or negligently by the guest or fellow
travellers.
§ 11 No statutory right of withdrawal
(1) Notice pursuant to Section 312g (2) No. 9 BGB: for accommodation contracts there is no statutory right of withdrawal. The cancellation terms set out in § 8 apply in its place.
§ 12 Data protection
(1) Our privacy policy applies.
§ 13 Final provisions
(1) German law applies, excluding the UN Convention on Contracts
for the International Sale of Goods.
(2) The place of performance and jurisdiction for merchants and
legal entities under public law is the seat of the operator
(Bitburg/Trier according to subject-matter jurisdiction).
(3) Should individual provisions be invalid, the validity of the
remaining provisions remains unaffected (severability clause).
(4) Online dispute resolution notice: the European Commission

(5) We do NOT participate in consumer arbitration proceedings
(Section 36 (1) No. 1 VSBG).
